There may be liability in negligence for failing to maintain your AED or for not providing training for your staff. "Failure to maintain an AED and to train persons in its use would be a breach of the 1998 Regulations by the employer" (Resuscitation Council UK, 2010)

Key points.

 

  • It may be possible to use a basis of liability to found a claim against an organisation that did not equip itself with AED
  • Failure to maintain an AED would be a breach of the 1998 Regulations by the employer
  • Failure to train staff/members in the use of your AED would be a breach of the 1998 Regulations by the employer
